Terms and Conditions
These Terms and Conditions ("T&C") govern the contractual relationship between Bogner Chess and its customers. They apply to every service booked through this website.
1. Scope and contracting party
These T&C govern the contractual relationship between Sebastian Bogner, Kornhausstrasse 1, 8840 Einsiedeln, Switzerland ("Bogner Chess") and customers who use the services offered by Bogner Chess. By booking a course, individual lesson, or any other service, you accept the version of these T&C in force at the time of booking.
2. Formation of contract
The presentation of offers on this website does not constitute a binding offer. Your booking is binding and is accepted by Bogner Chess through a booking confirmation (usually sent by email). The contract is formed upon dispatch of that confirmation. Bookings are processed via the Stamy Booking GmbH platform.
3. Services
Bogner Chess offers chess tuition in the following formats: youth group courses, individual lessons in person or online, holiday camps and intensive courses, and participation in tournaments. The specific content and scope is set out in the respective offer description at the time of booking. Minor deviations (for example a change of trainer in the event of illness, or a change of venue of comparable quality) are permitted and do not entitle the customer to withdraw from the contract.
4. Prices and payment
Prices are stated in Swiss francs (CHF) and, unless otherwise indicated, include any applicable value added tax. Payment is generally due immediately upon booking via the payment methods offered by Stamy Booking GmbH. Invoices are sent by email. Where, exceptionally, payment is made against invoice, the amount is payable within 14 days of the invoice date.
5. Cancellation and rescheduling of individual lessons
Individual lessons may be cancelled or rescheduled free of charge up to 24 hours before the agreed appointment. In the case of later cancellation or a no-show, the full lesson fee is due.
6. Cancellation of courses and holiday camps
The following cancellation rules apply to semester courses and holiday camps: • Up to 30 days before the course starts: full refund of the course fee. • 30 to 7 days before the course starts: 50% refund of the course fee. • Less than 7 days before the course starts: no refund. • After the course has started: no refund for missed lessons or for early withdrawal. Providing a replacement participant is possible in consultation with Bogner Chess.
7. Cancellation by Bogner Chess
If Bogner Chess has to cancel a lesson or course for reasons within its sphere of responsibility (for example illness of the trainer without a replacement), the lesson will be rescheduled or the pro-rata price will be refunded. Further claims are excluded.
8. Minors
Bookings for participants under the age of 18 must be made by a parent or legal guardian. The booking adult is deemed to be the contracting party and is in particular responsible for payment, for travel to and from the venue, and for supervision outside of the agreed training times. Bogner Chess only assumes a duty of supervision during the agreed training times.
9. Duties of participants
Participants undertake to treat trainers, other participants, and the training materials with respect. In the event of serious breaches or of lasting disruption of the course, Bogner Chess may exclude participants from further participation. No refund is owed in such cases.
10. Liability
Bogner Chess is liable in accordance with the statutory provisions. Liability for slight negligence and for auxiliary persons is excluded to the extent permitted by law. No liability is accepted for items, valuables, or clothing brought by the participant. Parents are liable for their children.
11. Force majeure
In the event of force majeure (for example official orders, pandemics, strikes, or natural events), Bogner Chess is entitled to postpone courses or individual lessons, or to convert them into a suitable alternative format (for example online tuition). A right of withdrawal exists in such cases only where the alternative is not reasonably acceptable to the customer.
12. Data protection
The protection of your personal data is important to us. Details on the nature, scope, and purpose of data processing can be found in our Privacy Policy. For the processing of bookings we use the SaaS platform of Stamy Booking GmbH as a data processor.
13. Intellectual property and use of content
All content published on this website (texts, images, videos, training materials) is protected by copyright. Reproduction, modification, or distribution beyond personal use is only permitted with the prior written consent of Bogner Chess. Games and analyses submitted by participants may be used by Bogner Chess for training and teaching purposes in anonymised form. Any further use (for example publication by name) only takes place with the participant's consent.
14. Subscriptions and memberships
Auto-renewing subscriptions are currently not offered. Should such subscriptions be introduced in future, the specific terms published at the time of the contract will apply, in particular regarding term, notice period, and price changes.
15. Changes to these T&C
Bogner Chess is entitled to amend these T&C with effect for the future. In the event of material changes, existing customers will be notified appropriately. Services already booked remain subject to the version of the T&C in force at the time of booking.
16. Applicable law and place of jurisdiction
Swiss law applies exclusively, with the UN Convention on Contracts for the International Sale of Goods being excluded. The exclusive place of jurisdiction, to the extent permitted by law, is the district of Einsiedeln, Canton of Schwyz. Mandatory places of jurisdiction for the protection of consumers remain reserved.
17. Severability
Should individual provisions of these T&C be or become invalid or unenforceable, the validity of the remaining provisions shall remain unaffected. The invalid provision shall be replaced by a provision that comes closest to the economic intent of the original.
